The Landy Agency offers Directors and Officers (D&O) and Employment Practices Liability (EPLI) insurance policies to both private and public companies as well as not-for-profit organizations. Directors & Officers Liability insurance can be paired with Employment Practices Liability in one Policy, or either can be purchased separately.

In addition, Crime coverage (employee theft or dishonesty, fraud, etc) can be included with these policies or can be obtained as a standalone policy.

Coverage can be extended to volunteers and committee members.

Employment Practices Liability Insurance (EPLI)

Employment Practices Liability insurance protects a business against lawsuits from past or present employees alleging wrongful termination, racial, sexual or gender discrimination, workplace harassment or retaliation. Coverage can include claims made by independent contractors, customers and vendors.

Crime Insurance Information & Options

Crime insurance can be an important option for both businesses and non-profit organizations, protecting against employee dishonesty and theft, embezzlement, employee fraud and wire funds transfer fraud. Common D&O/EPLI Questions

Can Directors be held personally liable for actions taken on behalf of a business or organization?
Yes, individual board members, as well as committee members and/or volunteers can be held personally liable for alleged negligence, failing to fulfill duties, duties of loyalty and care and many other acts or omissions.

How do I determine the right D&O and EPLI coverage for my entity?
Some of the things to consider include whether independent contractors or volunteers are used; does the company have a Human Resource Department and Personnel Manual, who manages the finances and is responsible for paying bills, payroll and other expenses, if a non-profit entity, are there By-Laws that explain rules of conduct, membership and other forms of participation.

Can I Get Coverage for D&O or EPLI on my Errors & Omissions or BOP (Business Owners Policy)?
Some Errors & Omissions or BOP policies include some coverage. Limits are typically low and coverage may be limited and may not protect all board members, only the Insured covered in the E&O or BOP policy. It is recommended that the entity itself hold more complete coverage spanning the activities of all members, volunteers, etc on behalf of the entity.
