RESPA QUESTION

Question: Can a mortgage broker, licensed with the California Bureau of Real Estate, pay a referral fee to a real estate agent?

Answer: No. Payments for a referral by a mortgage broker to a real estate agent constitute a RESPA violation. The only referral payments permitted under RESPA are from one real estate agent to another in a sales transaction.
